DETROIT, MI Thursday Feb.26.2004 /netmusiccountdown.com/ -- Grey Tuesday was a success, according to Downhill Battle, the group responsible for staging the 170 website download-fest of DJ Danger Mouse's "Grey Album." According to Downhill Battle, tens of thousands of people are now listening to the album EMI doesn't want you to hear. After issuing a blanket cease-and-desist to record shops around the world to prevent them from selling the unauthorized remixed Beatles/Jay-Z tracks, EMI set about shutting down Grey Tuesday as well, to no avail. Says DJ Danger Mouse in his statement regarding the web event: "It's flattering. I did this project because I love the Beatles and Jay-Z. I knew when I produced the Grey Album that there might be questions and issues that this project would bring up, but I really don't know the answers to many of them. It was not meant to be anything but an artistic expression, and I still hope that that is the way it's perceived".

EMI's cease-and-desist letter to participants of Grey Tuesday includes the following warning: "Any unauthorized distribution, reproduction, public performance, and/or other exploitation of The Grey Album will constitute, among other things, common law copyright infringement/misappropriation, unfair competition, and unjust enrichment rendering you and anyone engaged with you in such acts liable for all of the remedies provided by relevant laws."

It isn't known yet what, if any, punishment will be meted out to those who participated in this "day of coordinated civil disobedience."
